Multi Channel Network Pty Ltd, trading as Foxtel Media (Foxtel Media), represents the advertising interests of Foxtel and Fox Sports, along with other media and television assets spanning across subscription TV, websites and apps, catch-up TV services and Digital-Out-Of-Home screens. These programs collectively boast over 4.7 million subscribers, and as of 2024, Foxtel Media provides data and insights to over 3.1 million digital customers. Foxtel Media provides advertisers access to the worlds most loved and recognised entertainment brands and use their data, technology and people to ensure advertisers are able to connect with the right audiences across the large range of Foxtel Group assets.

Foxtel Media was the inaugural client for Edwards + Co.  Originally engaged in 2012 on a continuous retainer for corporate and commercial legal services, amongst the many matters we advised Foxtel Media on over many years were:

  • Core advertising sales representation agreements with television broadcast channels and digital publishers, and with advertisers and agencies that book sponsorship and advertising. This included redrafting the full suite of ad sales representation agreements to “future-proof” them for a digital era where content is available anywhere/anytime;
  • Negotiation and documentation of the ground-breaking new Multiview audience analytics and insights platform. Multiview combined the data assets and knowledge of Foxtel, National Australia Bank and Woolworths, through a SaaS platform built and maintained by leading data analytics firm Quantium;
  • All legal aspects of contracting arrangements with vendors and agency clients and publishers for programmatic TV platforms, including the establishment of the new SMARTHUB platform in 2018;
  • Acquisition of advertising sales rights for the Telstra digital advertising network;
  • Corporate and commercial advisory for MCN’s ad sales representative arrangements for Network Ten, including ad sales agreements, shareholder agreement and subsequent separation arrangements;
  • Advice with respect to corporate investment, board representation and shareholder agreement aspects of MCN’s founding interest in Think TV, which brought together representatives of the major subscription and free-to-air channels in Australia;
  • Negotiation and documentation of large, national Digital-Out-Of-Home advertising and sponsorship distribution deals with digital signage networks of premium shopping centres; and
  • Data and privacy compliance advice and recommendations with respect to the increasingly complex and onerous new data and privacy laws in Australia and overseas, including the new Notifiable Data Breach Scheme in Australia and the GDPR of the European Union.
